Kıdem Tazminatının Hesaplanması ve Zamanında Ödenmesi ile İlgili Hususların İncelenmesi
The concept of severance pay was introduced into Turkish law in 1936 with Labor Law No. 3008. Severance pay is one of the most contentious issues between employers and employees, significantly increasing the judicial workload. Due to lengthy legal proceedings, beneficiaries often receive their entitlements late or, in some cases, not at all. In this context, the importance of understanding the principles for calculating severance pay and ensuring its timely payment comes to the forefront. This study aims to examine issues related to the calculation of severance pay and the consequences of its untimely payment. The concept of severance pay is first defined, followed by an explanation of its legal nature. Subsequently, the study discusses the factors to be considered in the calculation of severance pay and outlines the calculation methods. The final section explains the potential problems arising from delays in severance pay payments. Severance pay is a critical right granted to employees as compensation for their long-term service, providing both financial security and recognition of their years of labor. Accurate calculation and timely payment are essential for protecting employees’ rights and ensuring that employers fulfill their legal obligations. The findings of the study highlight the importance of considering statute of limitations, ensuring accurate calculations, understanding the rights of both employees and employers, and adhering to legal regulations. Guaranteeing employees’ rights and ensuring employers meet their responsibilities are crucial for fostering a harmonious and stable working environment.
