La interacción entre el ODS 5, Meta 5.3 y el Derecho internacional privado español en materia de matrimonio. Una propuesta de lege ferenda

The United Nations 2030 Agenda, despite being a soft law, has been incorporated into autonomous private international law by some States. In our understanding, SDG 5, Target 5.3, should be used as a guide, principle, and right in regulating the right to marriage, incorporating it into Spanish private international law in the form of procedural guarantees that prevent forced marriages while respecting the evolving capacities of human beings. This paper presents the strengths and weaknesses of the Spanish marriage system and makes de lege ferenda proposals for its improvement.
