El aseguramiento de las responsabilidades pecuniarias en el proceso penal: entre el principio de oficialidad y el de justicia rogada

This article analyzes the legal framework applicable to precautionary asset measures within criminal proceedings, with special attention to the existing normative duality between ordinary and simplified procedures. Through a jurisprudential and doctrinal approach, it examines relevant aspects such as the unseizability of criminal fines, the material requirements for the adoption of precautionary measures, and the need for the applicant to provide a security bond. The validity of Article 589 of the Spanish Criminal Procedure Act is questioned in relation to the securing of prívate pecuniary liabilities, advocating for the application of the party initiative principie (characteristic of civil proceedings) regardless of the procedural track followed or even the jurisdiction in which the injured party chooses to claim the civil liability arising from a criminal offence.
