El derecho a la desconexión digital: ¿utopía o posible realidad?
This study aims to address the content and scope of the right to digital disconnection in light of the new provisions adopted, particularly those included in the draft Law for the reduction of the maximum length of the ordinary working day, the recording of working hours and the right to disconnect, and those in Chapter XV of the Fifth Agreement on Employment and Collective Bargaining. The analysis is based on the assumption that the right to digital disconnection requires a modification that mandates a legal definition that clarifies its content. It is necessary to establish the duties and obligations of workers and employers, as this has not worked as it should, without losing sight of the guidelines established by European provisions and its gender dimension. Likewise, it examines the subjective and temporal dimension of the right in light of the increasingly frequent judicial rulings demanding its protection.
