Типові слідчі ситуації в методиці розслідування зловживання впливом
The article is devoted to the development of typical investigative situations of the initial and subsequent stages of the investigation of abuse of influence. It is emphasized that criminal offenses are investigated in specific conditions of time, place, environment, relationships with other processes of objective activity, behavior of persons who find themselves in the field of criminal justice. This complex system of relationships forms the specific situation that has received the general name in criminology - investigative situation. The author, for the first time, based on the generalization of materials of criminal proceedings, stated the presence of an investigative and investigative-detective model of investigative situations, established the criteria that form the basis of their typification, in particular, concerning the type of subject of the criminal offense; method of commission; possible connection with other criminal offenses; subject of the criminal offense; source of information about the criminal offense; confirmation or refutation of the fact of committing a criminal offense; position of the suspected person; countermeasures to the investigation and an algorithm of actions in each of them is proposed. In addition, attention is paid to the need for operational and investigative measures aimed at establishing all the factual data and circumstances of the criminal offense committed. It is noted that, based on the results of the processing of empirical materials, we have established that for the completeness and proper collection of the evidence base, a typical program of an investigator (detective) at the initial stage of an investigation into abuse of influence should include: a) an appeal to the investigating judge with a request to conduct covert investigative (investigative) actions; surveillance of a person, thing or place; control over the commission of a crime; examination of publicly inaccessible places, housing or other possessions of a person; searches during detention at the place of work, residence or other possessions of a suspected person; interrogations of persons who have information about the official and other activities of the suspect; appointment of forensic examinations of seizure based on the ruling of the investigating judge on temporary access to things and documents.
