Siber Güvenlik Başkanlığının Düzenlenişine Dair Değerlendirme
Recent technological advancements have necessitated the establishment of new public administrations within the administrative organization of the Republic of Turkey. The Cyber Security Presidency has recently been incorporated into the administrative organization as a public legal entity. The novelty brought by the Presidency to administrative law is not only related to its field of activity but also to its organizational structure. Since the 2017 constitutional amendment, public legal entities have largely been regulated by the Presidential Decree (CBK), including matters that the Constitution stipulates should be regulated by law. However, the Cyber Security Presidency, although established by a CBK, is largely regulated by law in areas where legal regulation is anticipated. This difference raises questions about whether the legislative and executive branches truly consider criticisms in the organization of the Cyber Security Presidency. To answer this question, the article evaluates the regulation of the Presidency's duties, powers, and personnel. This evaluation shows that despite many constitutional provisions being regulated by law, they are insufficient to achieve the purposes intended by the Constitution.
