O direito absoluto da criança na área da saúde e as disparidades na aplicação da prioridade
This study investigates disparities in the implementation of the absolute right of children to health, focusing on the need for individualized care for children up to 12 years old, especially among vulnerable racial groups. The research is based on the Brazilian Constitution and the Child and Adolescent Statute, which guarantee absolute priority and comprehensive protection for children. The objective is to analyze the effectiveness of public policies and the roles of the State, family, and society in ensuring universal and equitable access to child healthcare, considering racial and socioeconomic inequalities that affect care. The methodology is deductive, using bibliographic review, legislative analysis, and epidemiological data to understand the extent ofdisparities in child healthcare. Results indicate that despite legal support, inequalities persist in access and quality of care, especially for Black, Indigenous, and Quilombola children, evidenced by higher vulnerability to diseases and less access to specialized treatments. The study concludes that the fulfillment of children’s right to health requires integrated public policies sensitive to racial and social specificities, ensuring continuity and comprehensiveness of care. It emphasizes the need to strengthen healthcare networks, train professionals, and monitor policies to ensure the principle of absolute priority is respected, promoting the full and healthy development of children.
