This essay concerns the relationship between factuality and legality of the affective relationship and the problem of contamination of the iustum matrimonium model in relation to the obligation of fidelity, and therefore on the extension of protection and the punitive nature of the violation, as well as the reversal of perspective between antiquity and modernity in relation to subjective rights and public interest.
