Medios de control de lo contencioso-administrativo frente a la reparación del daño generado por el acto administrativo: rezagos de la inmunidad del rey

The contentious-administrative mechanisms for the control of administrative acts in Colombia have traditionally followed an objective model focused on the abstract preservation of legality, without paying attention to the harm caused by administrative decisions. However, these mechanisms have gradually aligned with the constitutional paradigm, which emphasizes the protection of subjective or individual legal positions and the reparation of the harm caused, rather than the abstract preservation of the legal order in the face of administrative decisions. Despite this progress, the research reveals that substantive, procedural, and even metalegal obstacles still hinder the application of the principle of full reparation, preventing effective protection for victims of harm caused by administrative acts
