La Soberanía Humana del Derecho Internacional
By conceptualizing knowledge and applying the scientific-legal method, the qualitative investigative process was identified as a key component of legal research, following an epistemic approach that ensures logical coherence an expresses the essence of laws. This process transforms legal learning into a meaningful and effective outcome of education. Through dogmatic legal analysis, the study sought to validate or refute a hypothesis, thereby establishing a scientific legal truth or certain legal reality. An analysis of International Law and domestic legal framework revealed their continuous evolution, shaping legal security and state sovereignty. However, the sovereignty of individuals remains insufficiently recognized in International Law. While states exercise sovereignty, individuals still lack comprehensive legal mechanisms to exerciser their inherent and inalienable rights. In the current landscape, there is an urgent need to establish a coherent framework that ensures the universalization of human sovereignty within international and domestic law. Recognizing that the connatural sovereignty originates at birth, individuals delegate aspects of their sovereignty to governing bodies while retaining its fundamental essence. This principle must be upheld in the legal system to preserver dignity, equity and justice, ensuring that individuals fully exercise their rights in a just and inclusive society.
