Liberdade, boa-fé e a Constituição na interpretação do negócio jurídico
This paper aims to analyze the im-pacts of the Economic Freedom Act (“LLE” – Act 13,874/2019) on the interpretation of legal trans-actions, particularly regarding the enforcement of Article 113 of the Brazilian Civil Code. It demon-strates that the definition of economic freedom must necessarily incorporate constitutional axi-ology and its multidimensional nature. The study explores the concepts of freedoms, private auton-omy, and legal transactions within constitutional framework. Using deductive method and litera-ture review, it concludes that economic freedom, as established by LLE, can only be fully under-stood when aligned with constitutional princi-ples. Good faith, in its three dimensions, serves as a guiding thread for freedom in legal transac-tions, and through its ancillary duties, provides the necessary framework to effectively realize freedoms in practice.
