Implicaciones del componente motivacional sobre la lucha contra el crimen organizado

This article presents an update on the conceptualization of organized crime with the aim of promoting a reform in criminal policy and penal law applied in the fight against this type of criminal activity. There is a certain inconsistency regarding its current definition and the main instruments in the fight against organized crime, as it does not sufficiently take into account its motivational component. This lack of consideration hinders its control and potential eradication, making various changes necessary to adapt the fight against organized crime to its new reality.
