Entre el Reconocimiento y la Omisión: el Acceso a la Justicia de la Mujer Indígena en la Huasteca Hidalguense

This article analyzes the legal situation of Indigenous women in the Huasteca region of the state of Hidalgo, within the framework of the declaration of 2025 as the "Year of the Indigenous Woman" by the Mexican government, led by Dr. Claudia Sheinbaum Pardo, President of Mexico. Through an intersectional approach, it examines these women's access to justice by contrasting the current regulatory framework with the socio-legal realities they face in their communities. National and international instruments, as well as relevant jurisprudence, are explored to highlight the limitations of the current legal system. A qualitative approach is used to clarify this article, which provides meaning and human experience. Finally, concrete actions are proposed from a gender and intercultural perspective that contribute to closing the gap between law and reality in Indigenous contexts.
