The child’s best interest cannot be equated with the automatic recognition of parentage in favor of the intended parents, excluding the surrogate mother, without examining the circumstances of the specific case. Judges cannot create a general rule for attributing parentage, contrary to that established by the legislator. Depriving a child born -through a void surrogacy contract- of their maternal parentage directly undermines their best interests as minors, their right to know their origins, their right to be cared for by their parents, and their inheritance rights.

Abstract

The child’s best interest cannot be equated with the automatic recognition of parentage in favor of the intended parents, excluding the surrogate mother, without examining the circumstances of the specific case. Judges cannot create a general rule for attributing parentage, contrary to that established by the legislator. Depriving a child born -through a void surrogacy contract- of their maternal parentage directly undermines their best interests as minors, their right to know their origins, their right to be cared for by their parents, and their inheritance rights.
