Проблеми виконання вироків Міжнародного кримінального суду

The article comprehensively examines the system of enforcement of the International Criminal Court (ICC) verdicts and analyzes the problems faced by international justice at the stage of implementation of court decisions. The authors examine the legal and regulatory framework for the execution of ICC judgments, which is carried out on the basis of the Rome Statute and the Rules of Procedure and Evidence. Particular attention is paid to the problem of cooperation of states with the International Criminal Court in the execution of sentences. The article emphasizes that the effectiveness of international criminal justice largely depends on the willingness of states to cooperate, since the ICC does not have its own executive bodies and penitentiary system. The authors analyze in detail the issue of the voluntary nature of such cooperation, noting that the States Parties to the Rome Statute are not obliged to accept convicted persons to serve custodial sentences. The article discusses the problems associated with constitutional restrictions of some states on the use of life imprisonment and analyzes the procedure for serving a sentence of imprisonment in the States Parties to the Rome Statute. The mechanism of ICC supervision over the execution of sentences and conditions of detention of convicted persons, as well as the procedure for reviewing sentences and reducing sentences are studied.
