Сучасний стан та протидія дитячій порнографії
In the article, the author analyzes the criminological situation and the main aspects of combating child pornography. The concept of «child pornography» as defined in international conventions is revealed. It is noted that the basis for supplementing the Criminal Code of Ukraine with Article 301-1 was the adoption of the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine Regarding the Implementation of the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse (Lanzarote Convention)». It has been analyzed that there is a rapid growth in the number of registered criminal offenses related to child pornography. A review of the statistical data of the Prosecutor General’s Office of Ukraine shows that as of 2024 – 1809 criminal offenses related to child pornography were recorded, which is 181 criminal offenses more than in 2023. It is substantiated that there is a positive trend – a decrease in the share of this criminal offense in the structure of criminal offenses against public order and morality. At the same time, it was found that the share of criminal offenses related to child pornography in the structure against public order and morality is in first place. The role of international organizations in combating child pornography was investigated. It was determined that the key organizations in the field of combating child pornography are: «International Association of Internet Hotlines» (INHOPE), «End Child Prostitution, Child Pornography and Trafficking of Children for Sexual Purposes» (ECPAT), and «Internet Watch Foundation» (IWF). It is noted that Ukraine, represented by the public organization «Magnolia», joined the INHOPE hotline network in 2023. It is concluded that international organizations play an important role in combating child pornography, as their direct activities are aimed at identifying and removing illegal online content. In addition, they exchange information between countries on illegal online content, cooperate with law enforcement agencies and coordinate their work (Europol, Interpol, national law enforcement agencies) in the fight against this negative phenomenon.
