Особливості публічних закупівель у галузі будівництва за кошти грантового фінансування (grant funding) міжнародних валютно-кредитних організацій

The relevance of restoring the economy and infrastructure of Ukraine, which determines the growing role of the construction industry in meeting the needs of the state and local government, necessitates the effective use of grant funds as one of the methods of additional external international financing. It has been investigated that public procurement in construction using grant funding provided by international monetary and credit organizations is characterized by a number of specific features: the irreversibility and non-grant nature of the funds, the possibility of conducting public procurement in accordance with separate rules and procedures, determining the cost of construction without standard sample forms, the possibility of full or partial financing (co-financing), exemption from value-added tax and other taxes. The presented scientific article is dedicated to the analysis of the features of legal regulation of public procurement in the context of the construction industry and external grant funding. Starting with a review of existing legal laws and regulations, the study examines the main problems that arise in the context of the construction industry funded by grant financing, including the lack of a specialized law in the field of international technical assistance and discrepancies in defining the composition of participants in grant financing. We have concluded that grant funding from international monetary and credit organizations is one of the forms of international technical assistance. We pay special attention to the analysis of existing practices and practical challenges faced by participants and customers of public procurement in the construction industry using grant funding, as well as the search for optimal solutions to increase the effectiveness of the use of grant funding for the needs of the state and local government. The author of the scientific article also scrutinizes potential directions for reforming legal norms and regulatory mechanisms in order to ensure functionality and efficiency in the field of public procurement in the field of the construction industry using grant funding. It is suggested to consider the further prospects of scientific research and study of public procurement using international grant funding, taking into account the specifics of the construction industry, Ukraine’s reconstruction, and the goals of sustainable development.
