Законодавче забезпечення використання автономних наземних систем зі штучним інтелектом в Україні та розподіл відповідальності

The need to quickly restore the economy of Ukraine in conditions of lack of human resources, damaged infrastructure, technogenic pollution of territories, mine danger caused by the military aggression of the russian federation, will require the use of innovative methods and advanced technologies in business processes, public administration and the security sector. Autonomous ground systems (ANS) with artificial intelligence (AI), according to the author, have all chances of becoming one of the future drivers of economic growth. Analysts of Precedence Research predict the growth of global artificial intelligence in the transport market at 22.70% of the total average annual growth rate from 2024 to 2034. However, the productive and safe deployment of autonomous ground systems with artificial intelligence in Ukraine requires both additional equipment of technical infrastructure and appropriate legislative support, the existing legislative norms are built around the rights, duties and responsibilities of the human driver and the person providing transportation services. Instead, autonomous piloting technology requires new legislative approaches. The necessary legislative decisions should be made taking into account the world experience and the European integration goal. This study analyzes general regulatory acts of the European Union and the national regulatory acts of its individual members on the regulation of the use of autonomous terrestrial systems. The existing normative legal acts regulating the use of vehicles in Ukraine are analyzed. The questions of subjectivity of artificial intelligence and distribution of responsibility are considered. The result of the study was the need to amend the norms of the current legislation. The need to develop and implement a law on artificial intelligence, as well as responsibility for the occurrence of a traffic accident for the manufacturer of an autonomous ground system, the developer of software algorithms for artificial intelligence, the owner, the operator and AI, has been established. In further research, the author plans to focus on the issues of economic and legal stimulation of production and use of autonomous ground systems and the ability of artificial intelligence to bear legal responsibility as a road user.
