Unbased Assets and Confiscation of Property: Legal Aspects of the Interaction of the State and the Judicial System
Acquisition of unjustified assets is marked mainly by corrupt actions. In order to overcome them, it is important to focus not on what property was acquired illegally, but how exactly the procedure for acquiring unsubstantiated assets and the responsibility for their ownership took place. In the further research, we will talk about the special subject of committing this offense - persons authorized to perform the functions of state power or local self-government. Let's try to figure out whether it is really appropriate to use confiscation of property as a preventive element of responsibility for the acquisition and possession of unsubstantiated assets. In addition, it is necessary to consider the further improvement of legislative and judicial practice in the field of acquisition and possession of unsubstantiated assets, since this issue affects not only the property status of a specific person, but generally affects the image of the state among allies.
