Superendividamento da pessoa idosa, três anos após a vigência da Lei Federal n. 14.181/2021 no Brasil: O que temos a comemorar?
Over-indebtedness is one of the evils of the consumer society and consists of excess debt that leads the consumer to a situation of socioeconomic vulnerability. The elderly population is a large part of Brazilian society affected by this phenomenon, constituting around 14 million defaulters in 2024. From this perspective, in 2021, Law No. 14,181, known as the super-indebtedness law, was enacted. This work addresses over-indebtedness from the perspective of the elderly's hypervulnerability, highlighting how it was necessary to draft specific legislation, as well as public policies related to the topic. It is concluded that there is still a need for multidisciplinary treatment, through the restructuring of the Judiciary and other bodies, as well as the creation of digital platforms for debt negotiation, guaranteeing the dignity of the elderly in consumer relations.
