Penegakan Hukum Lingkungan Aspek Hukum Pidana: Kasus Kebakaran Hutan dan Lahan di Provinsi Jambi oleh PT Kaswari Unggul

Every year, environmental problems continue to increase and become increasingly uncontrollable. One of these environmental problems is forest and land fires. Jambi Province is one of the provinces in Indonesia with quite high levels of forest and land fires. One of the forest and land fires that occurred in Jambi Province was forest burning carried out by PT Kaswari Unggul. In an effort to follow up on forest and land fires caused by human actions, law enforcement against arsonists is an important step. This research aims to examine legal regulations and environmental law enforcement regarding forest burning in the criminal law aspect of forest burning cases in Jambi Province by PT Kaswari Unggul. This research is a form of normative juridical research using a qualitative descriptive approach and data collection techniques in this research were carried out by means of a literature study by analyzing literature related to the problem being studied. In conclusion, there are several regulations in enforcing environmental law based on criminal aspects that can be used to resolve cases of forest and land fires caused by PT Kaswari Unggul, including Article 98 paragraphs (1) and (2) of Law Number 32 of 2009.
