Indian Industries' Obligation Towards Benefit Sharing For Sustainable Development, Vis-À-Vis Biodiversity Amendment Bill
Abstract: This paper analyzes India’s biodiversity laws, focusing on the Biodiversity Amendment Bill, 2021. It explores the role of the Biodiversity Act, 2002, in promoting sustainable use and benefit-sharing, while examining the impact of the Divya Pharmacy case and the Nagoya Protocol. The study critiques the amendment for weakening compliance and favoring AYUSH practitioners, raising concerns about diluted benefit-sharing. It concludes by calling for a more integrated legal approach to strengthen conservation and ensure equitable access to biological resources.
