The Implementation of Ucc in Uttarakhand: A Model for Legal Reform or Political Experiment?
Abstract An important turning point in India's legal and constitutional debate was the implementation of the “Uniform Civil Code” (UCC) in Uttarakhand. The establishment of a UCC to guarantee consistency in personal laws among communities has long been envisaged by ‘Article 44 of the Indian Constitution’, but its actual implementation has proven to be socially and politically delicate. Uttarakhand has sparked a national discussion by spearheading the creation and proposal of a state-specific UCC. This study examines if this development represents a sincere attempt at social justice and legal modernisation or if it is largely a politically driven endeavour with little room for long-term change. With an emphasis on significant court rulings and legislative discussions, the research starts by looking at the UCC's historical development and constitutional foundation. Following that, it examines Uttarakhand's sociopolitical background while assessing the reasons behind, procedures for, and consequences of the state's UCC undertaking. As part of the research, the draft code's sections pertaining to ‘marriage’, ‘divorce’, ‘inheritance’, ‘adoption’, and ‘succession’ are closely examined to see how well they match with secularism, gender justice, and equality. The report also critically examines legal analysis, public reactions, and the larger political story behind the relocation. The viability of scaling Uttarakhand's model to the national level is assessed using a comparative methodology that makes reference to Goa's current civil code and comparable changes in other jurisdictions. The ultimate goal of this study is to provide a fair assessment of whether the state's UCC establishes a precedent-setting precedent or serves as a constrained, context-driven experiment.
