Legal risks for the modern development of innovative activities in the Ukrainian healthcare sector
This research explores the legal risks that are likely to hinder the development of innovative technologies in Ukraine’s healthcare. Despite extreme economic constraints and decreased scientific funding, the Ukrainian government actively promotes the integration of medical technologies (medtech), such as digital health and AI-driven tools, as essential instruments for rebuilding and strengthening healthcare delivery. Legislative initiatives and strategic policy documents underscore medtech’s national importance. The study highlights three pressing legal challenges: the absence of dedicated legal scholarship on medtech regulation, the lack of a clear connection between medtech implementation and ongoing healthcare reform, and the legal uncertainty surrounding the use of artificial intelligence in clinical settings. By identifying these legal gaps, the research calls for the urgent development of a consistent legal framework that ensures the safe, effective, and balanced application of medtech under wartime and post-war conditions.
