The Legal Landscape of Ai in India: Existing Frameworks and Future Regulatory Needs

Abstract The rapid advancement of artificial intelligence (AI) presents both opportunities and challenges for India's growing technology sector. While India currently lacks dedicated AI legislation, existing frameworks like the Information Technology Act, 2000 address crucial aspects of data protection, privacy, and cybersecurity relevant to AI systems. The National Strategy for Artificial Intelligence (2018) and NITI Aayog's ethical guidelines emphasize fairness, transparency, and accountability in AI development. However, key challenges remain in balancing innovation with regulation, particularly in addressing algorithmic bias and ensuring equitable AI deployment. The debate continues between proponents of comprehensive AI-specific legislation and advocates for adaptive regulatory approaches using existing laws. As India's AI ecosystem evolves, developing tailored legal frameworks incorporating ethical principles, robust data governance, and clear accountability mechanisms will be critical to harness AI's transformative potential while safeguarding public interest. Strategic collaboration between policymakers, industry, and academia will be essential to position India as a global leader in responsible AI development.
