Dispute de drept constituțional din anii premergători acordului dualist: cazul lucrării lui Wenzel Lustkandl privind dreptul constituțional ungar

Throughout the discussions during the years of the liberal regime regarding the ways of settling the constitutional dispute with Hungary, which represented one of the great problems of the Habsburg Empire, the disputes around the interpretation of older legal norms, even from previous centuries, played an important role. The ideas surrounding these were promoted by political representatives or specialists more or less involved in these political endeavors. It was mainly about the interpretations of fundamental historical documents, such as the Leopoldine Diploma or the Pragmatic Sanction, but they also resorted to approaching much older documents in support of an independent position of Hungary or a centralist perspective through the prism of Vienna. In all these disputes, an important role was played by the constitutional status of Transylvania, which, according to fundamental historical regulations, was a Grand Principality with its own Diet, a status that was contested by the Hungarian unionists who saw it as an integral part of the historical Hungary that had to elect deputies to the Diet of Pest and not to its own Diet and the Imperial Senate.
