ПИТАННЯ АДМІНІСТРАТИВНОГО ЗАХИСТУ ПРАВ ІНТЕЛЕКТУАЛЬНОЇ ВЛАСНОСТІ ЧЕРЕЗ АПЕЛЯЦІЙНУ ПАЛАТУ УКРНОІВІ

The article examines problematic issues of administrative protection of intellectual property rights in Ukraine and develops proposals for improving the legislative regulation of these issues. It is noted that in Ukraine the system of protection of these rights includes both judicial and administrative mechanisms, among which the Appellate Chamber of the Ukrainian National Office of Intellectual Property and Innovations occupies a special place. (IP OFFICE). The issue of the main functions of the appeals chamber is revealed. The issue of the post-grant opposition procedure is analyzed in detail. The author argues that administrative protection through the Appeals Chamber has a number of advantages compared to judicial proceedings. Based on the analysis of scientific approaches and judicial practice, conclusions were formulated that further improvement of the work of the chamber will contribute to strengthening the legal system and innovation potential of Ukraine.
