EXECUTAREA ORDINULUI SAU DISPOZIȚIEI SUPERIORULUI – CAUZĂ CE ÎNLĂTURĂ RĂSPUNDEREA CONTRAVENȚIONALĂ

Summary. The article represents an examination of one of the forms of legal responsibilityspecific to contravention law – contraventional liability. Contraventional liability can only be appliedif all the constitutive elements of the contraventional legal composition are met (object, objectiveaspect, subject, subjective aspect). However, there are situations where, although the act seems tomeet the characteristics of a contravention, certain specific circumstances at the time of its commission lead to the conclusion that, in reality, the author’s conduct is not illicit. The article substantiatesthe relevance and significance of the cause that excludes the contraventional nature of the act – theexecution of an order or directive from a superior as provided in Article 25’ of the ContraventionalCode of the Republic of Moldova.Key words: contraventional liability, order, disposition, honor and human dignity, contravention, cause that removes the contraventional character, execution.
