International investments and withdrawal from the relevant treaties

Abstract: This paper has attempted to analyze a particular and difficult sector, i.e. the right of withdrawal from treaties, with special attention to treaties on international investments. The majority of treaties are based on resolving disputes through arbitration. A subject that is analyzed by the Bilateral Investment Treaties (BITs) and those of the EU. The issues are not so much of a procedural nature but concern mostly the legitimation as well as the responsibility of a system that is in conformity with the rules of international law, of the European Union as well as with a jurisprudence that does not follow a unanimous line of thought but different paths for each case of withdrawal.
