CARACTERISTICILE LATURII OBIECTIVE ALE CONTRAVENȚIEI DE VIOLENȚĂ ÎN FAMILIE

Summary. Domestic violence is one of the most serious problems facing contemporary societies, a problem that has existed in all times, in all countries and civilizations. Domestic violence isdifferent from other forms of violence because it takes place between family members. On the otherhand, there are numerous characteristics that contribute to a greater or lesser extent to defining family violence as a misdemeanor. Family violence is a profound phenomenon that is often associatedwith consequences of a different nature, being considered insignificant in the view of the aggressor,but which are actually quite hard for the victim. And society, through the authority of the contraventional law, draws the individual’s attention to the fact that committing acts of violence against a familymember is contrary to humanity, no matter how insignificant the physical or any other consequencesmay be. Therefore, the main purpose of the research is based on identifying the characteristics ofthe objective side of family violence, which would allow the correct qualification of violent actionscommitted by a family member as a misdemeanor.Key words: violență, violența fizică, violență în familie, contravenție, faptă prejudiciabilă, maltratare, vătămare corporală, vătămare neînsemnată a integrităţii corporale.
