The Right of Victim Compensation in India: A Legal Perspective
This research analysis the concept of victim compensation in India is rooted in the broader principles of restorative justice, which seeks to address the needs of the victims, the offenders, and the community as a whole. Victim compensation is viewed not only as a mechanism to offer financial assistance to those who have suffered as a result of crime but also as a moral obligation of the state to provide support to victims of crime. While the primary purpose of the criminal justice system is to punish offenders, there is growing recognition that the harm caused to victims must also be addressed, particularly in the case of serious offenses such as murder, rape, and other violent crimes. The state’s role in victim compensation is also an area of significant concern. While compensation is provided in certain cases, the amounts awarded are often insufficient to meet the needs of victims, particularly in cases involving severe physical or psychological trauma.
