A study on Patentability of Traditional Knowledge and Ayurveda Based Products in India

Abstract: The creation of mind is termed as Intellectual Property. This includes inventions, artistic works, literary works, designs, symbols, names and certain images used in trade and commerce. Intellectual Property Rights confer the creator an exclusive right over the use of his/her creation. Traditional knowledge is the knowledge people gain through experience and which is transmitted orally from generations to generations Ayurveda is practiced in India as a regular medical system like standard medicine. Patentability of Ayurveda Products or Traditional Knowledge Products is always challenging. This paper focus on current scenario of patentability of traditional knowledge based products and Ayurveda products in India. It specifically puts light on challenges and issues in patent granting of traditional knowledge based products and Ayurveda products in India.
