Legal Responsibility for Plagiarism of Artistic Works in Indonesia

This study examines the disharmonization of music licensing regulations in Indonesia from the perspective of copyright law protection, with a focus on the implications of inconsistencies between national regulations and international agreements on the validity of licensing agreements between creators and copyright holders. The method used in this study is a normative method with a statute approach and a conceptual approach. The statute approach is used to analyze the provisions in the Copyright Law and related regulations, while the conceptual approach is used to discuss the legal concepts underlying music licensing regulations and copyright protection in global and national contexts. The results of the study indicate that the disharmonization of music licensing regulations has the potential to create legal uncertainty, which is detrimental to the position of creators in licensing agreements. Furthermore, this inconsistency also hinders the protection of creators' exclusive rights as stipulated in international instruments such as the WIPO Copyright Treaty and the TRIPS Agreement. Therefore, this study recommends the need for regulatory harmonization through the strengthening of the institutional framework of Collective Management Organizations and the establishment of more transparent national licensing clause standards to create legal certainty and protect creators' copyright more effectively.
