The Effectiveness of Arbitration in India (Challenges, Enforcement & History)
Arbitration in India has emerged as a pivotal mechanism for resolving commercial disputes, offering a streamlined, private, and party-driven alternative to conventional litigation. In recent years, arbitration has become an increasingly attractive option for resolving legal disputes. The statement "Will See you in court" has given way to "Sit together and settle" due to the arbitration's beneficial outcomes. Over the years, a number of revolutionary methods and techniques have been established in our legal system. Designed to uphold the principles of autonomy, efficiency, and finality, the Indian arbitration framework is governed by the Arbitration and Conciliation Act, 1996 a legislation inspired by global standards yet tailored to domestic needs. The transformation of arbitration from a peripheral concept to a mainstream dispute resolution tool reflects India's evolving legal values speed, specialization, and procedural flexibility. With the rise of institutional arbitration and the establishment of dedicated arbitration centres, India is steadily positioning itself as an attractive venue for both domestic and international parties. Yet, the journey toward becoming an arbitration powerhouse demands more than just legal reform; it requires cultivating a culture of trust, professionalism, and enforcement certainty. This article examines the legal landscape of arbitration in India, critically analyzing the synergy between legislative intent and judicial approach, while evaluating the nation’s readiness to position itself as a global arbitration hub. The paper concludes with recommendations for strengthening arbitration culture through consistent policy measures, enhanced infrastructure, and a paradigm shift toward institutionalization.
