WORLDWIDE EXPERIENCE OF ANTI-CORRUPTION POLICY IMPLEMENTATION IN THE PRIVATE LEGAL SPHERE
The article substantiates that corruption risks, along with the public and legal sphere, are spreading in the private sector as well, which necessitates the development of anti-corruption strategies of modern states that take into account the corresponding threats in the private sphere. On the basis of the analysis and generalization of the foreign experience of Great Britain, Germany, France, and the USA, it has been proven that in order to prevent and counter corruption in the private legal sphere, it is important to criminalize corruption manifestations in the private sphere, with the allocation of independent articles in the criminal codes; introduction of financial control measures in companies; creation of audit committees; development of codes of corporate conduct and recommendations and commitments on influence measures that can be applied by companies to prevent bribery. It is proved that the key aspect of the fight against corruption, which increases the effectiveness of the anti-corruption strategy, is the formation of a mechanism for countering corruption lobbying aimed at limiting the illegal influence of private interests on political decisions.
