Psychological Aspects оf Judicial Conflicts
Researching the psychological mechanisms behind the emergence and escalation of conflicts within judicial proceedings is relevant to enhancing the effectiveness of judicial activity, reducing conflict levels, and ensuring fair justice. The purpose of this study is to examine the psychological aspects of conflict emergence in the judicial sphere. Factors influencing the development of judicial conflicts are explored. It has been found that "person-to-person" conflicts (conflict between prosecutor and defense attorney, prosecutor and defendant, prosecutor and defense witness, attorney and victim, attorney and prosecution witness, defendant and victim) are objective, as they are programmed by the very procedure of case examination. It is emphasized that none of the objective conflicts involve the judge, allowing the judge to participate only in subjective conflicts.
