Since 2003, in order to benefit descendants with disabilities, article 808 of the Spanish Civil Code has allowed for the establishment of ordinary trusts over the reserved portion belonging to the other forced heirs. This interesting provision did not have any real social impact, as many doubts weighed it down as a result of its defective drafting. This article has been reformed by the Law 8/2021, which has introduced, for the first time in our legal system, the residuary trust. However, the prospects are not encouraging, insofar as this is a clear example of dysfunctional legislative activity: instead of shedding light on this matter, the legislator has fostered further uncertainty. In this paper we confine our research to the subjective aspects of the aforementioned article, where countless issues remain unanswered by the legislator.
