4857 Sayılı İş Kanunu Çerçevesinde İş Güvencesinin Uygulamada Yaşanılan Sorunlar Temelinde İncelenmesi
The main purpose of labor law, which regulates the employment relationship between the parties and determines the boundaries of the said relationship, is to protect the economically weak and dependent worker against the employer by ensuring the balance between the parties. In Law No. 4773, there is a provision that job security will be applied in workplaces with 10 or more workers. However; with the Labor Law No. 4857, the number of 10 workers was changed to 30 workers. It is obvious that the scope of job security has been narrowed down to a certain extent by increasing the number of workers that need to be employed in order to be included in the scope of job security from 10 to 30 people and that a significant number of workers have suddenly been left out of job security. Job security has both individual and social effects. Therefore, while making arrangements regarding job security, it is necessary to examine job security in terms of its social effects. Considering these conditions, the Labor Law No. 4857, which entered into force within the scope of this study, will be examined on the basis of both its individual and social effects.
