Jurisdiction for The Resolution of Business and Commercial Disputes by The Court Under the Vietnam Civil Procedure Code 2015 – Status and Some Proposals

In Vietnam, courts play a vital role in resolving business and commercial disputes. Proper determination of jurisdiction under the Civil Procedure Code 2015 is essential for ensuring procedural efficiency, reducing litigation costs, and enhancing legal certainty. However, the current legal framework reveals inconsistencies and overlaps, particularly in the classification of civil versus commercial cases and the interpretation of jurisdictional rules. Based on a review of legal provisions and practical data from the Vietnamese court system, this paper identifies key shortcomings in jurisdictional application and proposes legal and institutional reforms to improve dispute resolution mechanisms in the context of Vietnam’s evolving market economy.
