INFRACȚIUNEA DE ECOCID ÎN CODUL PENAL AL REPUBLICII MOLDOVA

The article addresses the topic related to ecocide. The doctrinal essence of ecocide,as reflected in the opinions of scientists, is analyzed, citing as an example local researchers such as Al.Barbăneagră, X. Ulianovschi, S. Brînza, V. Stati, A. Cauia, among others. The Criminal Code of theRepublic of Moldova is analyzed in the context of the reference to the notion of ecocide. The correlation between ecocide and ecological security is described. The applicability of ecological legislationis exemplified. As a conclusion, the article affirms that the Criminal Code of the Republic of Moldova,by incriminating ecocide in art. 136 following the process of harmonizing national criminal law withinternational environmental law, applies in accordance with the provisions of the Constitution of theRepublic of Moldova and international acts to which the Republic of Moldova is a party.Key words: Security environment, the crime of ecocide, international law, United Nations Environment Programme, Criminal Code of the Republic of Moldova, Constitution of the Republic ofMoldova, ecological security, ecosystem.
