Maitland and Europe

This article considers two points of connection between FW Maitland, the father of modern English legal history, and continental scholarship. The first part examines personal connections, with a focus on the background to Maitland’s Township and Borough. The second part looks at Maitland’s knowledge of non-common law doctrine through his Selected Passages of Azo and Bracton. Together, the article seeks to show the close attention paid by Maitland to continental scholarship.
