Neochota odvolacích soudů doplňovat dokazování jako příčina nepřiměřené délky civilního řízení
The excessive length of civil proceedings is a current issue not only in the Czech civil process. Ensuring a reasonable length of civil proceedings is a fundamental duty of a democratic state governed by the rule of law, which is therefore obliged to identify and eliminate the causes of the prolongation of civil proceedings. This paper focuses on one of these causes, namely the conduct of the appellate courts, which consists in their reluctance to complete evidence in the appellate proceedings. The aim of this paper is to propose measures to eliminate this cause while respecting the procedural rights of the parties and to assess its potential impact on the length of civil proceedings.
