Azerbaycan İş Hukukunda İş Sözleşmesinin Sona Erme Nedenleri ve Hukuki Sonuçları

This article deals with the reasons, procedures and consequences of termination of the employment contract in Azerbaijan labor law. Enacted in 1999, the Azerbaijani Labor Code contains comprehensive provisions aimed at balancing the rights of the employer and the employee. One of the most striking features of Azerbaijani labor law is the requirement of a written form for the conclusion and termination of employment contracts and the obligation of digital registration through the state portal system. In this respect, it differs from Turkish labor law and, contrary to the principle of freedom of contract, it introduces a system that adopts the requirement of written and official form. In this study, unilateral termination of the employee or the employer, expiration of fixed-term contracts, change of working conditions, transfer of the workplace and various termination situations against the will of the parties are examined. The article compares the labor laws of Azerbaijan and Turkey and draws attention to the similarities and differences in terms of the termination process, compensation rights and job security. This comparative approach aims to provide a comprehensive assessment of the labor law systems of both countries.
