Carsharing Agreement: Concept and Relation to other Agreements

Currently, such a phenomenon as "carsharing" is gaining increasing popularity both in Russia and around the world. The reason for this hype is the very mechanism of functioning of "carsharing", which provides users with the opportunity to use a car for a short time without having to purchase it, based on digital technologies. Despite the obvious advantages of carsharing, the legal nature of this agreement remains a matter of debate among legal scholars. There is no single regulatory definition of a carsharing agreement in Russian legislation, which leads to the need to qualify it through the prism of existing civil law institutions. The article examines the legal nature of the carsharing agreement, analyzes its features and the relationship with vehicle rental agreements without crew and rental agreements. The problems of the lack of regulatory consolidation of the concept of "carsharing" in Russian legislation and disagreements in judicial practice are emphasized.
