Administracja oparta na wiedzy – problemy prawne

The article analyses mainly Polish and European administrative law publications in order to reconstruct the terms ‘knowledge-based administration’ and ‘expert’. It has carried over examples of ‘experts’ and their role in the decision-making process of public administrators. In this regard, the analysis particularly focusses on the issue of reasonability as an element of the democratic legitimacy to govern. Public administration, among other things, because of technological and civilisational progress, does not have a monopoly on knowledge and must demonstrate the validity of its actions. For this purpose, it becomes necessary to use external, independent expertise as well as to continually process and reuse and appropriately manage the existing data. De lege ferenda postulates are presented in the conclusions of the article.
