Some issues of determining the goal of ensuring human reproductive rights
The article raises the issue of the purpose of ensuring reproductive rights. It is noted that with the development of technology, there is a need to review the adequacy of ensuring reproductive rights, considering modern challenges and the capabilities of new technologies. Despite the prohibitions in the field of genetic engineering, which are enshrined in international acts, there are no guarantees of their observance and as a result, all these provisions may be violated. All this requires meticulous attention to the formation of a strategy of state policy in the field of ensuring reproductive rights. The article makes the following conclusions and reservations: the right to information within the framework of the implementation of reproductive rights plays an extremely important role; the purpose of legal ensuring reproductive rights determines the direction, boundaries and content of measures. We should not forget about the restrictions in the field of genetic engineering, medical ethics and in general in the field of human rights regarding permissible measures to ensure reproductive rights; proper regulation of the implementation of reproductive rights is about creating a real opportunity for their implementation. However, within the framework of the problems of ensuring reproductive rights, there are serious global issues related to the preservation of the genome. Therefore, any goal must be comparable to the preservation of the human genome to create conditions for the survival of humanity, that is, conditions for the realization of reproductive rights; the development of technology is not always an argument for expanding the essence and content of rights if this contradicts the principles of preserving the human genome. However, it should be emphasized that the guideline cannot be what people are ready or not ready to accept. Reproductive rights are limited by the biological nature of the human body. Adding properties that are not inherent in a healthy person may mean not only a violation of ethical rules, but also an irreversible violation of human biological characteristics, which as a result may have unpredictable consequences; the most important, but not the only goal is the preservation of the biological species and ensuring the survival of humanity, since it does not aim at the pursuit of happiness and ensuring the rights of a particular person. Within the framework of ensuring this goal, the refusal to have children can be considered as an obstacle to the preservation of humanity and the preservation of the biological species. The goal must be correct and take into account the balance between public and private interests; The decision of each state influences global approaches to interpreting the content and limits of what is permissible in the field of ensuring reproductive rights, through the practice of the ECHR.
