Methods of Controlling and Proving Islamic Jurisprudence A Comparative Analytical Study

The main idea of the research is to explain the methods of proof in Islamic jurisprudence and the extent of compatibility with what the Saudi regulator has adopted in the system of proof. The importance of the research lies in the fact that the right may exist but without the means of proving it. The evidence is what establishes the right and shows it. Therefore, the importance of the methods of proof comes in showing The truth and its explanation, and the problem of the research appears in answering the questions: What are the methods of proof approved by Sharia law and decided by Islamic jurist. One of the most prominent results I reached is that the authority of acknowledgment of the Qur’an, Sunnah, consensus, and reason has been established, and that evidence is applied to everything by which the truth is clarified and demonstrated. And that testimony is obligatory in the rights of human beings except the rights of God, and that breaking the oath is abstaining from it when directed to the defendant by the judge at the request of the plaintiff. The issuance of the evidence system represents a shift in the judicial field in the Kingdom of Saudi Arabia, as it contributes to accelerating the settlement of disputes, reducing the scope of jurisprudence and the resulting conflicts in rulings.

The importance of the research lies in the fact that the right may exist but without the means of proving it. The evidence is what establishes the right and shows it.
