POST-TERM RESPONSIBILITIES OF NOTARY (WERDA NOTARY)
The Notary profession is a specialized field of work that requires physical and intellectual abilities and is carried out on an ongoing basis with the aim of earning income. This profession has characteristics such as being limited to a particular field, requiring special expertise, being permanent, prioritizing service, having responsibility for oneself and society, and joining a professional organization. In the context of the legal profession, Notaries have duties, functions, and roles that are regulated based on a certain code of ethics. The Law on Notary Position (UUJN) explains that Notary as a public official is authorized to make authentic deeds, keep deeds, and issue copies or grosses. An authentic deed made by a Notary has strong legal force and becomes perfect evidence in court. However, there is a lack of clarity in the UUJN regarding the time limit for the responsibility of a retired Notary (werda notaris) for the deed he/she made. Article 65 of the UUJN states that the Notary is still responsible for the deed he made, even though the protocol has been handed over to the depositary. However, there is no specific legal protection for werda notaries, resulting in a legal vacuum. Legal protection for werda notaries is needed to ensure legal certainty and justice, especially regarding the responsibility for deeds made during their term of office. This research uses a normative juridical approach method by analyzing primary and secondary legal materials, such as legislation, literature, and journals. The analysis is carried out systematically and consistently to answer questions regarding the responsibilities of notary public and the legal protection provided post-period of office.
