Ceza Mahkemesi Kararlarının Hukuk Mahkemesine Etkisi ve Hükmün Açıklanmasının Geri Bırakılmasının Durumu

In some instances, a criminal prosecution arising from a specific act may also form the subject of civil litigation. In cases where two separate legal proceedings are initiated based on the same act, a question arises regarding whether the decisions rendered in these proceedings influence one another. The objectives of criminal and civil proceedings differ, and the procedural rules governing each are not identical. Therefore, it might be conceivable that decisions made in distinct legal proceedings do not affect each other. However, since the subject matter of these proceedings pertains to the same factual event, contradictory decisions could undermine legal certainty. In this regard, it becomes essential to examine the relationship between criminal and civil justice systems. The study explores how decisions made in criminal proceedings influence civil litigation, the legal grounds for such influence, and whether unfinalized criminal court decisions have any bearing on civil courts.
