Intellectual Property Law in Pakistan: Challenges and Opportunities for Innovation

This study explored the implications of the intellectual property (IP) law structure in Pakistan on the potential for innovation and creative growth in the country. It evaluated the IP challenges and opportunities in Pakistan in relation to legislation, enforcement, and awareness among relevant stakeholders, which the study describes and analyses as business entrepreneurs and policymakers. Using a qualitative approach, the researchers undertook extensive interviews with legal professionals, patent attorneys, and policymakers in the four main regions of Pakistan and in the capital, Islamabad. The research uncovered substantial gaps in the implementation of IP laws, contrary to the perception of a sophisticated and comprehensive legal regime. The primary reasons for the lack of innovative protections to low public awareness, weak enforcement IP law provisions, and long enforcement processes. Still, the research uncovered prospects on the enforcement of IP laws, including the increase of public enforcement IP awareness campaigns and the patenting of emerging protected ecosystems of startups and enhanced digital patenting-initiation ecosystems. There is a significant lack of judicial enforcement IP capacity, while legal illiteracy remains among creators of innovation toward the enforcement of IP regimes. This study asserts that Pakistan has the foundations of an IP regime, but large gaps in enforcement, stakeholder IP-based education gaps, and weak institutional IP enforcement and regulatory gaps. These gaps hinder promising innovation and creative entrepreneurship in the country. These gaps hinder promising innovation and creative entrepreneurship in the country.
